When you visited the United States Institute of Peace last July, you pledged that you would be “fair, just and scrupulously follow due process and the rule of law, as enshrined in [the Nigerian] constitution” in prosecuting corruption.

Such loftiness is laudable. As the Bible instructs in Amos 5:24: “[L]et justice roll down like waters, and righteousness like an ever-flowing stream.”

But to be just, the law must be evenhanded. It cannot, in the manner of Russian President Vladimir Putin, be something that is given to punish your enemies and withheld to favor your friends. If so, the law becomes an instrument of injustice bearing earmarks of the wicked rather than the good.

In the United States, you declared a policy of “zero tolerance” against corruption. You solicited weapons and other assistance from the United States government based on that avowal. But were you sincere?

During your election campaign, you promised widespread amnesty, not zero tolerance. You elaborated: “Whoever that is indicted of corruption between 1999 to the time of swearing-in would be pardoned. I am going to draw a line, anybody who involved himself in corruption after I assume office, will face the music.”

After you were inaugurated, however, you disowned your statement and declared you would prosecute past ministers or other officials for corruption or fraud. And then again you immediately hedged. You were reminded of your dubious past by former Major General and President Ibrahim Badamasi Babangida, who succeeded your military dictatorship. He released this statement:

“On General Buhari, it is not in IBB’s tradition to take up issues with his colleague former President. But for the purpose of record, we are conversant with General Buhari’s so-called holier-than-thou attitude. He is a one-time Minister of Petroleum and we have good records of his tenure as minister. Secondly, he presided over the Petroleum Trust Fund, PTF, which records we also have.

We challenge him to come out with clean hands in those two portfolios he headed. Or we will help him to expose his records of performance during those periods. Those who live in glass houses should not throw stones. General Buhari should be properly guided.”

You then swiftly backed off your zero tolerance policy because you would have been its first casualty.

You opportunistically announced that zero tolerance would be narrowed to the predecessor administration of Goodluck Jonathan because to probe further would be “a waste of time.” That conclusion seems preposterous. In 2012, the World Bank’s ex-vice president for Africa, Oby Ezekwesili, estimated that a stupendous $400 billion in Nigerian oil revenues had been stolen or misspent since independence in 1960. The lion’s share of that corruption spans far beyond the Jonathan administration.

Your zero tolerance policy seems to come with a squint to avoid seeing culpability in your political friends. A few examples are but the tip of the iceberg.

A Rivers State judicial commission of inquiry found that N53 billion disappeared from the Rivers State Reserve Fund under former governor Rotimi Amaechi. Former Lagos governor and head of your campaign finance team Babatunde Fashola was accused of squandering N78 million of government money to upgrade his personal website. The EFCC has ignored these corruption allegations, and you have given both promotions: the Ministry of Transport to Mr. Amaechi, and the Ministry of Power, Works, and Housing to Mr. Fashola.

In contrast, you have played judge, jury, and prosecutor in the newspapers to convict former PDP Petroleum Minister Diezani Alison-Madueke of corruption.

Is this evenhanded justice?

United States Supreme Court Justice Robert Jackson taught: “[T]here is no more effective practical guaranty against arbitrary and unreasonable government than to require that the principles of law which officials would impose upon a minority must be imposed generally. Conversely, nothing opens the door to arbitrary action so effectively as to allow those officials to pick and choose only a few to whom they will apply legislation and thus to escape the political retribution that might be visited upon them if larger numbers were affected.”

To investigate or prosecute based on political affiliation or opinion also violates Articles 2 and 7 of the Universal Declaration of Human Rights. It is unworthy of a great nation like Nigeria.

Make the hallmark of your administration justice, not retribution, and you may live for the ages.

I am a United States citizen and lawyer. I have no political standing in Nigeria. Some might argue that my speaking about the administration of justice in Nigeria bespeaks impertinece. But you chose to visit the United States to solicit weapons and other assistance from my government–a government of the people, by the people, for the people. The United States government represents me. What the United States government does reflects on me. I thus have an interest in addressing the actions of foreign governments that receive United States government aid.

Speaking with journalists after the proceedings, Bruce Fein said: “Today was the fifth time I was told I could not enter the courtroom despite the court’s previous order that Nnamdi could have access to any three persons he wants to.


“I had the chance to talk briefly to him on my way to the courtroom. It is clear that I am the target in particular. That’s the reason why this proceeding did not transpire today.

“And I’m here to tell Nigerians and the international community that I’m taking this to international tribunals. It is clear that the Nigerian tribunals are compromised.”

The lawyer said he will petition “the Working Group on Arbitrary Detention in Geneva, the International Court of Justice in the Hague, the ICC in the Hague and I’ll be going to the United States Congress and urging that sanctions be considered against Nigeria for gross violations of fundamental human rights”.

“I’m here not to be an irritant but there are huge international law issues that are present in Nnamdi Kanu’s case. I’m here because I’m an international expert to provide more enlightenment on what legal issues are present here,” Fein added.

Dear Mr. Chairman: 

On behalf of the 50 million Igbo people of Nigeria, organized under the umbrella of the Indigenous People of Biafra (IP013), led by Nnamdi Kant', the Nelson Mandela of Nigeria, this oflicc together with Nigerian Barrister Aloy Ejimakor (IPOB general counsel) calls your attention to the Nigerian government's authorized shootings and killings of Mr. Karat's guests at his home by elements of Nigerian Army late Sunday, September 10, 2017. 

We are convinced the Nigerian government intended to assassinate Mr Kano because of his Igbo ancestry, Judaic religion, and political views. Its nefarious designs were thwarted by the unanticipated presence of numerous visitors to Mr. Kann at the time of his scheduled extrajudicial murder by the Nigerian Army under color of Nigerian law. 

According to credible Nigerian newspaper reports, many of the visitors were seriously wounded in the Army attack.

Fatalities have been reported. Due to the developing nature of this incident, definitive information is unavailable at this time. But enough is known to justify an international response to prevent convulsion in Nigeria that would threaten international peace and security.

Mr. Nnamdi Kant' and IPOB have been peacefully protesting the systematic persecution of Igbos—who overwhehning Christian and Jewish--by Muslim and Hausa-Fulani President Muhammadu Buhari and his murderous administration. (Twelve Northern Nigeria States have adopted sharia as their legal code). They have been brutally attacked with lethal force by Nigerian security forces to punish the exercise of their fundamental rights to freedom of speech, religion, and association. Credible sources, including Amnesty International, have confirmed that more than 100 unarmed Igbos/IPOB members have been murdered in separate incidents implicating the Nigerian Army. 

We represent legal representatives of ten of the murdered or tortured Igbo victims in a Torture Victims Protection Act lawsuit currently pending before the United States District Court for the District of Columbia. But the lawsuit alone has not been sufficient to deter Nigeria's Muslim, Hausa-Fulani government from seeking to exterminate 50 million Igbos because of their religion and ethnicity. The Nigerian government has tacitly endorsed a Hausa-Fulani plan in Northern Nigeria to expel 11 million Igbos and plunder their property beginning October I, 2017. The earmarks of an impending genocide and failed state in Nigeria are unmistakable.

We thus strongly urge you to consider employing all diplomatic tools at your disposal to communicate your concerns over the attempted September 10 assassination of Mr. Kanu and ongoing Nigerian State terrorism against the 50 million Igbos. Among other things, we urge you to communicate your concerns to the Nigerian Embassy in Washington, D.C., the Nigerian Mission at the United Nations, and the Office of the Presidency of the Federal Republic of Nigeria, Abuja, Nigeria.

Bruce Fein Asks Ifeanyi Ejiofor To Withdraw From Nnamdi Kanu, IPOB Leader's Legal Team

Bruce Fein, the American lawyer of the detained leader of the Indigenous People of Biafra, Nnamdi Kanu, has written to Ifeanyi Ejiofor, a member of Kanu's legal team, urging him to immediately refrain from representing the agitator. 


In a letter from Bruce Fein Ifeanyi Ejiofor, he noted that Ejiofor was not eligible to defend Kanu against the Nigerian Government's amended charges in the court, citing a pending lawsuit instituted by a businessman against Ejiofor over an alleged fraud of N5.6 million. 

Fein pointed out that Ejiofor had a case to answer and that the allegations were not concocted by the Nigerian government to preempt his representation of Nnamdi Kanu. 

The American lawyer, therefore, urged Ejiofor to immediately withdraw from Kanu's legal team.

According to the public record, you have a blatant conflict of interest in representing Nnamdi Kanu to defend against the Federal Government of Nigeria’s amended charges in the Federal High Court of Nigeria, Abuja Judicial Division Holden in Abuja, Charge No: FHC/ABJ/CR/383/2015 in violation of Rule 10 of the Nigerian Rules of Professional Conduct.

“The public record shows you have a conflicting interest to sabotage Nnamdi Kanu’s defense in exchange for leniency or a pardon in the pending fraud prosecution against you in FRN v. IFEANYI EJIOFOR & 2 ORS, CHARGE NO. CR/950/2020, Court No. 3, FCT High Court, Maitama, before Honourable Justice M.E. Anenih. The next hearing in your prosecution is scheduled for March 30, 2022. 

“The public record establishes that the fraud charges were not concocted by the FGN to preempt your representation of Nnamdi Kanu. The record shows the charges were triggered by a complaint from a private businessman with no political or other ulterior motive to defame or handicap you: Okpala Comas Ikechukwu. 

“Among other things, he stated in a complaint to the Economic & Financial Crimes Commission that you defrauded him of N5,600,000.00 by conspiring to represent forged land or title documents as authentic. 

“Nothing in the public domain demonstrates that you shared your conflict of interest with Nnamdi Kanu and received his knowing and voluntary written consent to represent him notwithstanding the conflict. 

“You are saddled with a professional and personal duty to recuse yourself immediately from further representation of Nnamdi Kanu and to apologize for your neglect to do so earlier. 

“As the Bible preaches (Matthew 6: 24): 'No one can serve two masters.' I expect you to do the right thing.”

WHY BRUCE FEIN WANT EJIOFOR REMOVED AS COUSEL FOR NNAMDI KANU

One thing you should know about the legal profession is that it is governed by certain ethnical rules and standards, much of which is contained in the rules of professional conduct. Your relationship with your lawyer is not governed only by the contract you signed with him for his services. You can rely on the fact that your lawyer’s actions are also governed by the rules of professional conduct. 

The key part of the rules of professional conduct is that the lawyer must always act in the interest of his client. If he acts in any other interest apart from that of his client, then there is a CONFLICT OF INTEREST. Lawyers must avoid conflict of interest at all cost. 

CONFLICT OF INTEREST IN EJIOFOR’S REPRESENTATION OF NNAMDI KANU:

Ejiofor is facing serious criminal charges with very damning evidence. Without a plea bargain, Ejiofor is most likely going to be convicted and sent to prison for at least 15 years. So, Ejiofor is desperate for a favor from the Nigerian government and that favor is the plea bargain, to give him a soft landing. At the same time, Nnamdi Kanu is facing treason and terrorism charges by the Nigerian government, and is presently in detention. For Ejiofor to represent Nnamdi Kanu, there is a real likelihood that his judgment and efforts will be affected by his desire to gain favors from the Nigerian government. He needs to please the government to get the favor. To defend Nnamdi Kanu, on the other hand, he needs to disagree with the same government. The desire to disagree is sharply opposed to the desire to please. If you are desiring to oppose a person that you are also desiring to appease, there is conflict. Sometime, some kind of kind of conflict can be solved by simply informing your client the truth and allowing him to choose. But Ejiofor never disclosed the conflict to Nnamdi. Recently, after this matter became public and Nnamdi became aware of it, Nnamdi asked Ejiofor if it was true that he faced criminal charges. Ejiofor lied to him by telling him it was an old matter that had been settled. So, rather that disclose the conflict, Ejiofor lied to Onyendu in order to perpetuate the conflict. 

Not only Bruce Fein; all the lawyers involved in Nnamdi Kanu’s case have the obligation to protect Nnamdi Kanu from the harm which Ejiofor’s conflict of interest exposes him (Nnamdi) to. Chief Ezekhome had a duty to protect Nnamdi from Ejiofor. Barrister Aloy Ejimakor has a duty to protect Nnamdi from Ejiofor. And Bruce Fein has such duty too. The rules of professional conduct are more rigorously enforced in America than in Nigeria. So, it is not a surprise that while other lawyers kept quiet, it was Bruce Fein that had to speak out. But also, these lawyer could all claim they were not aware of the conflict. In fact, when I decided to expose Ejiofor, I knew that I was placing all the defense lawyers in an ethical dilemma. I acted on purpose. I made them aware of the qagmire and that should trigger their sense of obligation. If you recalled, I had said that I would personally write a letter to Chief Ezekhome to WARN him of the implications of having Ejiofor in the defense team. The problem is that many of you don’t pay attention to details. Otherwise, you would understand what I meant by planning to notify Ezekhome. I wanted to place Ezekhome in a position where he would not be able to claim to be unaware of the Ejiofor situation. 

Honestly, if Ejiofor remains in the defense team, Nnamdi Kanu can later sue Ezekhome, Ejimakor and others for professional malpractice in that they knowingly failed to avert the harm caused by Ejiofor’s presence in the defense team. Bruce Fein is aware of that. He had to perform his duties by international standards of legal ethics. 

The irony of it all was that it was Ejiofor that engaged Brue Fein for the case. Nnamdi Kanu had known of Bruce Fein all along and had dealt with him before. When Nnamdi was brought into Nigeria, he wanted to have strong international legal presence in his case. Ejimakor is a fantastic lawyer with international experience, and he made instant impact in the case. Yet, Nnamdi felt that more was better than less. So, he directed Ejiofor to hire Bruce Fein for him. The fact that it was Ejiofor that transmitted the letter that hired Bruce Fein, does not mean that there was any doubt as to who was Bruce Fein’s client or what interest he was hired to protect. He knew he was hired for Nnamdi Kanu, and not for Ejiofor. And once Ejiofor threatened his client (Nnamdi Kanu), Bruce had to do whatever he could to protect his client. On the other hand, because Ejiofor is not that clever, he assumed that Bruce Fein was answerable to him, rather than to the client. 

The further irony here was that Ejiofor actually worked hard to elevate the role of Bruce Fein. Remember that Ejiofor walked out on the court just because Bruce Fein was not let into the court. Why? Was it because Ejiofor loved Bruce Fein so much? No! Immediately Bruce Fein entered into the case, Ejiofor saw a means of playing down the role of Ejimakor. Because Ejimakor is far superior to Ejiofor on international legal matters, especially as regards rendition issues, Ejiofor aimed to downplay Ejimakor by projecting Bruce Fein. I totally understand these things because I know all the players well. Bruce Fein worked for my law firm ECULAW Group in Washington DC. He was Of Counsel to the firm for years. Also, I knew Ejimakor as fellow lawyer in Washington DC and I am aware of his excellent professional practice in Washington. I have an idea of the strengths of these lawyers and the contributions they could make to Nnamdi Kanu’s defense. Bruce Fein and Ejimakaor had something in common – They are American trained and they have experience in Washington DC. So, they will see the law and approach issues in similar fashion. So, it was quite easy to try to use one against the other. But in the end, the two gentlemen managed their roles brilliantly and never complained. Instead, it was Ejiofor that was getting into trouble.

There is another theory to bear in mind here. Assuming all the Nnamdi Kanu’s defense lawyers had decided to get Ejiofor out of the team, how best would you expect them to go about it? Do you expect Chief Ezekhome to be the one to tell Ejiofor to step down? Do you expect Ejimakor to be the one to tell Ejifor to take a walk? First, Emeka Ugwuonye told Ejiofor to step down and Ejiofor attacked Emeka. These lawyers would not want Ejiofor attacking them on the social media. So, the best thing would be for them to tell Onyendu to tell Bruce Fein to tell Ejiofor to withdraw. You really have to understand what is going on. I am not saying I knew this to be a fact. That is why I called it a theory. But the important thing is that the job is done. Since he refused to withdraw, he has to go by other means. In the African proverb, there are different ways to skin a rat without shedding its blood.

IPOB Reacts To Bruce Fein Letter To Ifeanyi Ejiofor

Mr. Bruce Fein advice to concentrate on issues in United States of America and other foreign jurisdiction, with the exclusion of Nigeria.

Following the recent publication by Sahara Reporters, purporting a demand letter by Mr. Bruce Fein, we the global movement and family of the Indigenous People of Biafra (IPOB) under the command and leadership of our great leader Mazi Nnamdi KANU wish to categorically make it known to the public that Mr. Bruce Fein has no authority whatever to decide or make pronouncement on the choice/status of neither the legal team of our Leader, Mazi Nnamdi Kanu nor of the IPOB Lead Counsel.

Mr. Bruce Fein should recall that he wasn't in the first place appointed Mazi Nnamdi Kanu's International Spokesperson/Legal Representative by this trail blazing IPOB Lead Counsel - Sir Ifeanyi Ejiofor, Esq whom he today, is trying to castigate and defame because of little token of fifty thousand dollars offered to him every trip he made to Nigeria by these infamous Umuada highway in USA and that thing in Finland claiming to be unfortunate deciple. 

We are baffled that Mr Bruce Fein could belittle himself and reducing himself to allowing them to deceive him by talking like a demented fellow. How could a well intelligent and a professional lawyer would be using this kind of words to his fellow lawyer in the world. 

The women in America sent Bruce Fein to Abuja to persuade our leader Mazi Nnamdi KANU to order him and women to inaugurate government in exile which when this aberration failed to materialise as it is unconscionable to be contemplating forming a Biafran govt in exile when our leader is in the hand of our enemies. After this unsuccessful move to set up a govt in exile the grudges against Sir Barrister Ifeanyi Ejiofor began to take form.

These traitors in America and infiltrator in Finland thought that our Legal Representatives were the ones who stopped their gimmicks and antics, without knowing that IPOB have surpassed government in exile. 

The powers conferred on Mr. Bruce Fein by our Leader vide the IPOB Lead Counsel is to be exclusively exercised in the United States of America and other foreign jurisdiction, with the exclusion of Nigeria.

Pertinent to note is the fact that Mr. Bruce Fein set his feet in Nigeria shortly after the abduction and extraordinary rendition of our Leader vide the invitation letter extended to him by our Lead Counsel - Sir Ifeanyi Ejiofor, which visa issued in respect thereof still subsist till date.

Several attempt to visit our leader either in Court or the DSS facility by Mr. Bruce Fein were all rebuffed by both the DSS and the Court respectively. All formal correspondences towards making those visits feasible were exclusively handled by the IPOB Lead Counsel. 

We however, observed that Mr. Bruce Fein started avoiding our Lead Counsel after our Lead Counsel declined to cooperate with him in getting our Leader to sign a totally strange document that could have negatively impacted on the status quo.

From that moment, Mr. Bruce Fein pitched tent with sworn enemies and detractors of our struggle. No wonder he is today, ranting from a foreign land.

The general public is hereby, respectfully urged to disregard Mr. Bruce Fein's claims as they are baseless because he is being induced into ranting this infamous statements. We reiterate that the IPOB leadership have implicit and unshaken confidence in our erudite teams of lawyers, who have creditably distinguished themselves as a sound and indefatigable advocates.

Mr. Bruce Fein is advised to focus on the international briefs provided to him to handle on behalf of our Leader, which we have not seen any tangible results since he started handling them in the USA and desist forthwith from further defaming our amiable Legal Luminary. IPOB appreciate and love his commitment and focus in handling our leader's and our case. 

The IPOB Lead Counsel has since taken to court, the authors of the libellous publication, upon whose original defamatory publication Mr. Bruce Fein relied on. 

We therefore, appeal for calm while the court decides. 

Let good conscience and wise counsel prevail. 

Barrister Ifeanyi Ejiofor led team of lawyers worked relentlessly for the release of our leader Mazi Nnamdi KANU in 2017 until he was granted bail. So Bruce Fein should asked questions if he don't know about that.
